Insurance (Personal)
Why do I need insurance?
Most of us have insurance, whether for our home, our possessions, our car or in case we die unexpectedly. Insurance protects us against unexpected events to make sure we don’t suffer financial loss. In return for paying “premiums” (usually regular monthly payments) to an insurance company, you are protected against unexpected losses (such as theft) or against claims by someone else if you have been at fault (for example, if you have been involved in a car accident and caused damage to the other vehicle).
Insurance companies will assess how much of a risk you are and calculate the premiums accordingly. If you are considered to be a high risk (for example, a young person learning to drive), the premiums will cost more. Provided you pay the premiums, the event for which you are insured happens, the insurance company will reimburse you for your losses.
Those providing professional services will have insurance cover for professional indemnity, to insure them against claims of professional negligence.
Why do I need legal advice?
Insurance is a legal contract between the insurer (the insurance company) and the insured (the person or company paying for insurance). You may be in dispute over an insurance claim or simply not be clear about the terms of the insurance. A barrister expert in insurance can advise you on where you stand.
Why do I need a barrister?
There are many legal issues associated with insurance. A barrister who is expert in insurance will be able to advise you on contracts you have entered into, the validity of claims and anything else to do with insurance. If you are in dispute, they can advise you on the options open to you. Barristers are experts in the law, are best placed to advise on the right course of action and will argue your case to the highest standard in any tribunal or court.
Is mediation right for me?
If you are in dispute over an insurance issue, you don’t have to go to court. You should also consider mediation, which can be less stressful and cheaper. myBarrister can connect you to specialists in mediation who can help you resolve your dispute.
